Equipment donated by the Orchestra – control and the legal aspect
All equipment purchased by the WOŚP Foundation is transferred solely to those healthcare centers which have signed a contract with the National Health Fund, in other words to only those hospitals which provide free-of-charge assistance. Each medical device is a free donation. However, being the donor, the Foundation reserves the right to control the donee, as have been written in the provisions of the contract of donation. Furthermore, the donor imposes upon the donee the obligations as listed below:
Since the Foundation has purchased a great amount of equipment – some dozen thousand devices – we are not able to check ourselves whether they are all used properly. We can, however, count on the mechanisms of social control. Thanks to the information we are provided by the people, the Foundation is able to intervene in any case of abuse. In practice, the Foundation reacts to such information. Whenever the donated devices are used improperly, e.g. when the hospitals charges the patients for using them or when they are transferred to another department, we can act. Besides, in the event of reorganization of healthcare units, the hospitals which are to be closed down should request the Orchestra’s permission for moving the donated equipment to other newly-opened institutions. Before such permission is granted, the Orchestra always checks what kind of unit it is an whether it will be able to fulfill our conditions – to treat and diagnose many children without charging. |
